Buying and Selling a Home?

ASSISTANCE WITH PURCHASING A HOUSE

Buying or selling a house can be one of the most important decisions a person makes during his or her lifetime. It is an expensive purchase and should be reviewed by a qualified attorney so you fully understand what you are signing. My team at Kent A. Jeffirs, Attorney at Law, PC understands all aspects of real estate law and I am well-equipped to assist you in purchasing or selling a house.

THE IMPORTANCE OF A PURCHASE AGREEMENT

A common error people make is to sign a purchase agreement, which is as significant as the actual deed, without first consulting an attorney. A purchase agreement should contain a property description, conditions of sale, the terms of payment, the type of deed, the date of possession, provisions for the furnishing of title evidence, distributions of real estate taxes and casualty losses. Additionally, it can include a variety of stipulations, including being contingent on an inspection, the sale of your current home or the replacement of fixtures. I have more than two decades of experience and can evaluate your purchase agreement to help you understand the terms and conditions you are accepting.

YOUR RIGHTS AND RESPONSIBILITIES UNDER INDIANA’S RESIDENTIAL DISCLOSURE LAW

If you are purchasing or selling a house, it is important for you to understand Indiana’s Residential Disclosure Law. This law requires sellers to complete a Residential Property Disclosure Form, which discloses information about the house’s condition to the prospective buyer. Although it is possible to give the form to the buyer after the purchase, the buyer then has the right to rescind the agreement within a certain period of time. If you are purchasing or selling your home, I can explain your rights and obligations to you under Indiana’s Residential Disclosure Law.

OBTAINING A TITLE

When you are obtaining a title, it is beneficial to obtain a “marketable” title, or one which is free of all reasonable doubt or threat of litigation. Title evidence may include an Owner’s Title Insurance Commitment and Policy, abstracts of title or an attorney’s title report. In addition to a title examination, it may be beneficial to obtain a warranty deed. Although mortgage lenders may have their own agents examine the property titles, it may be in your best interests to seek the assistance of an objective attorney who has no incentive for closing the sale. If you are purchasing or selling a house in Lake County, I can review the title evidence for you.

CLOSING REAL ESTATE SALES IN LAKE COUNTY

One of the first steps to closing a real estate sale is to sign the contract and place a deposit on the house after it has been thoroughly reviewed by an attorney. After applying for a mortgage and meeting with your lender, you should obtain an organized report from a home inspector. After your mortgage company appraises your new home and sends you a commitment letter, you should discuss it with your attorney. If it is acceptable, your lawyer can confirm the closing date of the house.
