If you are purchasing or selling a house, it is important for you to understand Indiana’s Residential Disclosure Law. This law requires sellers to complete a Residential Property Disclosure Form, which discloses information about the house’s condition to the prospective buyer. Although it is possible to give the form to the buyer after the purchase, the buyer then has the right to rescind the agreement within a certain period of time. OBTAINING A TITLE
When you are obtaining a title, it is beneficial to obtain a “marketable” title, or one which is free of all reasonable doubt or threat of litigation. Title evidence may include an Owner’s Title Insurance Commitment and Policy, abstracts of title or an attorney’s title report. In addition to a title examination, it may be beneficial to obtain a warranty deed. Although mortgage lenders may have their own agents examine the property titles, it may be in your best interests to seek the assistance of an objective attorney who has no incentive for closing the sale. After your mortgage company appraises your new home and sends you a commitment letter, you should discuss it with your attorney. If it is acceptable, your lawyer can confirm the closing date of the house.
